Eyeris Web Care Packages - Terms and Conditions

1. Contract Duration and Cancellation
  • Minimum Contract Period: The minimum contract length for any Eyeris Web Care package is 1 year.
  • Cancellation Within Contract Period: If the client cancels the subscription within the 1-year contract period:
    • The website and all associated services will be immediately suspended upon cancellation.
    • All data, including backups, will be permanently deleted without further notice, and Eyeris WebTech will not be liable for any data loss.
  • Cancellation After Contract Period: If the client cancels the subscription after the 1-year contract period:
    • Eyeris WebTech will retain backups of the website and associated data for a maximum of 3 months post-cancellation.
    • After the 3-month period, all data will be permanently deleted unless the client requests an extension for backup storage, which may incur additional costs.
2. Payment Terms
  • Subscription Payment: Website development will only commence once the first month’s payment has been received. The website will be delivered within the first month of the subscription, covering the costs of templates, hosting, plugins, and other essential resources.
  • Monthly Payments: Payments are due on a monthly basis, on the date specified in the invoice.
  • Annual Payment Option: Clients may opt to pay for the entire year upfront and receive a 20% discount on the total annual subscription.
  • Late Payment:
    • A 5% late fee will be added to any invoices not paid by the due date.
    • If two consecutive invoices remain unpaid, Eyeris WebTech reserves the right to take the website offline and suspend services until full payment, including any late fees, is received.
  • Service Reactivation: To resume services after suspension due to non-payment, the client must settle all outstanding amounts, including a reactivation fee of AUD $50.
3. Service Suspension and Termination
  • Non-Payment: If two consecutive monthly payments are missed, Eyeris WebTech reserves the right to take the website offline without prior notice. Services will only be resumed once full payment of all outstanding invoices, including late fees and reactivation fees, is received.
  • Termination for Breach: Eyeris WebTech reserves the right to terminate services immediately if the client breaches any of the terms and conditions, including but not limited to non-payment, inappropriate use of services, or violation of intellectual property rights.
4. Data and Backups
  • Regular Backups: Backups of the website will be performed according to the client's chosen package:
    • Essential Care: Daily backups.
    • Pro Care: Every 6 hours.
    • Premium Care: Every 1 hour.
  • Data Retention on Cancellation:
    • Within Contract Period: All data, including backups, will be permanently deleted immediately if the contract is terminated early, and Eyeris WebTech will not be liable for data loss.
    • Outside Contract Period: Data will be retained for up to 3 months after cancellation. After this period, all data will be permanently deleted unless a data retention extension is requested by the client (additional charges may apply).
  • Client Request for Data: Clients may request a copy of their website data at any time, provided their account is in good standing. However, a fee may be charged for such requests, depending on the scope of the data.
5. Scope of Services
  • Website Development: The development of the website will commence once the first subscription payment has been received, with the completed website delivered within the first month. This model ensures that costs for templates, hosting, plugins, security setup, and other necessary resources are covered.
  • Website Maintenance: Maintenance services included in the packages cover core CMS updates, security checks, uptime monitoring, content updates, performance optimisation, broken link/error checking, and technical SEO fixes, based on the specific package features.
  • Website Makeover: Clients are entitled to a full website makeover every 3 years (Essential Care), 2 years (Pro Care), or 1 year (Premium Care), ensuring the website remains modern and in line with business growth.
  • Technical SEO Fixes: All packages include ongoing technical SEO services, such as fixing broken links, enhancing page load speed, and ensuring the website remains mobile-optimised.
  • Performance Optimisation: Performance optimisation is scheduled as follows:
    • Essential Care: Every 6 months.
    • Pro Care: Every 3 months.
    • Premium Care: Monthly.
  • Content Updates: Clients are entitled to 1 hour/month (Essential Care), 4 hours/month (Pro Care), or unlimited updates (Premium Care).
6. Refund and Dispute Resolution
  • Refund Policy: Payments for services rendered are non-refundable. This includes completed milestones or portions of the website project. No refunds will be provided for cancellations, especially for services already rendered or in progress.
  • Dispute Resolution: Any disputes or issues with invoices or services must be reported in writing within 7 days of the invoice date. Failure to dispute within this period will result in automatic acceptance of the invoice as final.
7. Client Responsibilities
  • Content and Media: The client must provide all required content (text, images, etc.) for the website in a timely manner. Delays in content provision may result in project delays and potential additional costs. Eyeris WebTech will not be responsible for missed deadlines if the client fails to supply required materials on time.
  • Third-Party Licenses: Clients are responsible for acquiring and maintaining any third-party software licenses or subscriptions, including premium plugin licenses, unless explicitly agreed upon as part of the package.
8. Confidentiality and Data Protection
  • Confidentiality: Eyeris WebTech is committed to protecting the confidentiality of all client information. Client data will not be shared with any third party without prior written consent, except where required by law.
  • Data Protection: Eyeris WebTech will take all reasonable steps to secure and protect client data from unauthorised access or breaches. However, clients are encouraged to maintain their own backups of important content and data as a precautionary measure.
9. Amendments to Terms
  • Changes to Terms: Eyeris WebTech reserves the right to amend these terms and conditions at any time. Clients will be notified at least 30 days in advance of any changes. Continued use of services after such changes will constitute client acceptance of the new terms.
  • Client Acceptance: By using our services, clients agree to all terms and conditions as set forth in this document. Continued use of services confirms acceptance of these terms.
